Terms of Service
Last modified 28 October 2026
Talkscope is a website and online service owned and operated by TinyMentions, Inc., a Delaware corporation (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of Talkscope’s website, application and related services (the “Service”). By creating an account or using the Service you agree to them. If you use the Service for a company or other organisation, you agree for it and confirm you have the authority to; “you” then means that organisation too.
1. The service
Talkscope is a business-to-business research tool. It finds the creators, influencers and authors who already publish about the problem a business’s product solves, scores how well each fits with the evidence for the score, looks for a published way to contact them, and drafts a first message for a person at the business to review. It is for professional use by businesses; it is not offered to consumers, and you may use it only if you can form a binding contract.
The Service changes as we build it. We may add, change or remove features, or stop offering the Service, sometimes without notice.
2. Your account and the early-access trial
Talkscope is in private beta: accounts are by invitation only. An invited account starts on a free trial of 14 days, with 1 project(s) and a hard spending cap of $25 a month on the paid work the Service does for you (searches, reading and contact lookups). When the cap is reached, the work stops for the month; it is never charged beyond it. No payment details are taken during the beta.
Give us accurate information, keep your password to yourself and tell us at once if you suspect someone else is using your account. You are responsible for what happens under your account. We may refuse, suspend or close an account at our discretion, including when an invitation was used by someone other than the person it was sent to.
3. Where the data comes from
Talkscope reads only public sources: published web pages, newsletters, podcast feeds and directories, and official platform interfaces (for example, the YouTube Data API for a video’s details). It does not log in to any site to read it, does not solve captchas, and does not access LinkedIn in any way. Contact details come from public pages, from business-contact lookup services, or from what you enter yourself. Every fact Talkscope stores keeps the link it came from, so you can check it.
4. Outreach: drafts only
Talkscope sends no email or message to anyone on your behalf. It drafts a message; a person on your team must review it, pass the pre-send checklist and approve it, and then sends it themselves — by copying it, opening it in their own mailbox, or using the creator’s contact form. You are the sender of every message you send, and you are responsible for it: its content, its accuracy, and its compliance with the laws that apply to you and to the recipient (for example, anti-spam and data-protection law, including identifying yourself and honouring a request to stop).
5. Scores and drafts are machine-made
Fit scores, summaries, the evidence chosen for them and message drafts are produced with language models (provided by OpenAI) and automated rules. They can be wrong, out of date or incomplete. Read the evidence and the draft before relying on them; nothing Talkscope produces is advice, and no decision about a person is made automatically — your team decides whom to contact.
6. Acceptable use
You agree not to, and not to try to:
- use the Service for anything unlawful, or to harass, threaten, stalk or deceive anyone;
- send spam or bulk unsolicited messages using anything the Service produced, or contact a person who has asked you, us or Talkscope not to be contacted;
- work around a do-not-contact mark, a suppression, the spending cap or any other limit of the Service;
- use the Service to collect information about people who are not creators — their readers, commenters, followers or anyone else;
- resell, republish in bulk or share outside your organisation the creator data the Service shows you, or use it to build a competing database or service;
- scrape, copy, reverse engineer or overload the Service, or get around its security;
- let someone outside your organisation use your account.
We may investigate a breach and suspend or close the account involved, with or without notice.
7. The people in the database
The creators Talkscope helps you find have rights over their data. Any creator can ask to be removed at talkscope.co/remove-me; when they do, they disappear from every list, including yours, and no business using Talkscope can contact them through it again. A creator’s request not to be contacted applies to your whole organisation and cannot be undone by you. The privacy notice explains what is held about creators and why. If a creator asks you directly to stop, stop, and mark them do-not-contact.
8. Known limits of the service
We would rather you hear these from us:
- Pages can try to influence the ranking. Talkscope reads text written by others. A page can contain instructions or claims aimed at the models that read it, and they can move a creator’s score up or down. Treat a score as a lead to check, not a verdict.
- Video transcripts. Where a video has a transcript, Talkscope reads it to understand what was said. A transcript can be missing or imperfect.
- A beta, with no service level. The Service runs on a single production environment with no separate test environment; changes go live directly, and it can be slow or unavailable at times. There is no uptime commitment or service credit during the beta.
- Where it runs. The Service is hosted on Google Cloud, us-central1 (USA), with OpenAI, SendGrid, Sentry, Decodo and Anymail Finder as processors.
9. Your content
What you put into Talkscope — the description of your product, your notes, your edits to drafts, the contact details you add — stays yours, and you are responsible for having the right to use it. You let us store and process it only to run the Service for you. We treat it as confidential and do not use it to serve another customer.
10. Our property and feedback
Subject to these Terms, we give you a non-exclusive, non-transferable, revocable licence to use the Service for your organisation’s own business during your subscription or trial. The Service, its software and its name and marks belong to us and our licensors. Feedback you send us is voluntary, and we may use it without any obligation to you.
11. Privacy
The privacy notice describes what we hold about creators and about people who ask for early access. For the creators you research, you and we each act as a controller of our own part: we of the discovery database, you of your own outreach, notes and records.
12. Suspension and ending
You may stop using the Service and delete your account at any time from your settings. We may suspend or end your access if you breach these Terms, if the law requires it, or if we stop offering the Service. When an account is deleted, its data is deleted from the Service and cannot be recovered; a creator’s do-not-contact mark stays, because it protects that person.
13. No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. WE DO NOT WARRANT THAT THE SERVICE, ITS SCORES, ITS CONTACT DETAILS OR ITS DRAFTS ARE ACCURATE, COMPLETE OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS.
14. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL OR DATA, ARISING FROM THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. THESE LIMITS APPLY WHATEVER THE LEGAL THEORY, EVEN IF WE WERE TOLD THE DAMAGE WAS POSSIBLE.
15. Indemnification
You will defend and indemnify us, our officers, employees and contractors against claims, losses and costs (including reasonable lawyers’ fees) arising from the messages you send, your use of the data the Service shows you, your content, or your breach of these Terms or the law.
16. Changes to these terms
We may revise these Terms. The current version is always on this page with its date; a material change is emailed to your account’s address before it takes effect. Using the Service after a change takes effect means you accept it; if you do not, stop using the Service.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules; the UN Convention on Contracts for the International Sale of Goods does not apply. We will first try to resolve any dispute informally by email. If that fails, the state and federal courts located in Delaware have exclusive jurisdiction, and both of us consent to them.
18. Everything else
You may not assign these Terms; we may assign them to a successor. If a provision is found unenforceable, the rest stays in force. Not enforcing a provision is not a waiver of it. These Terms are the whole agreement between you and us about the Service. Questions: feco@talkscope.co.
